TERMS & CONDITIONS

On paying a deposit to rent a self-catering holiday at Huerta Pequena, hereinafter referred to as ‘The Property’, the person or persons and guests renting the property, hereinafter referred to as ‘The Renter’, agrees to the following terms and conditions:

A contract between the renter and the owners of the property, hereinafter referred to as ‘The Owners’, will come into existence on receipt of a deposit and the owners acceptance of a booking by issuing a booking confirmation. The contract binds the renter and all members of the renter’s party. It is the responsibility of the renter to ensure all members of their party also accept the terms of the contract set out in these terms and conditions.

The renter agrees to pay the owners a 20% deposit within 72 hours of receiving confirmation of booking from the owners. After 72 hours the owners reserve the right to cancel the booking if the deposit is not received. Following the deposit, full and final payment must be paid no later than 8 weeks prior to the first date of the renter’s booking. Failure to pay by the required time may result in the renter losing the booking and incur cancelation costs.

All cancelations must be immediately notified by telephone and then in writing. The renter agrees to the following cancelation policy. Guests will be given a full refund if a booking is cancelled more than 8 weeks before arrival. Thereafter, between 4 & 8 weeks before arrival a 50% refund (less deposit) will be given. With less than 4 weeks before arrival, the refund amount will be discretionary depending on cancelation circumstances.

It is the renter’s responsibility to take out comprehensive travel insurance and ensure all of their party have adequate insurance too. If the renter or party members choose not to take out any insurance they take full responsibility for any loss that may be incurred due to any cancelation.

The owners will not cancel a booking except in exceptional circumstances beyond their control. Notification will be given of the cancellation as soon as possible and prompt refund of any payments made. The owner’s liability will be limited to payments made to them by the renter.

On arrival at the property the renter agrees to pay a refundable cash security deposit of 200 Euros against the damage to the facilities, property and loss of keys. The owner will return the security deposit on the final day of the renters booking or, if the renter is checking out at a time not convenient for the owner (i.e. outside of normal check-out times) the owner will forward the security deposit by an agreed means with the renter. For the latest replacement costs or for costs associated to loss of keys, please ask the owners.

The renter is aware that the property is only licensed for a maximum of 6 persons and will not under any circumstance exceed the licensed maximum number of people allowed to stay in the property. If the renter exceeds the maximum number they will automatically forego their security deposit and may be at risk of their rental being terminated without any refund.

The renter agrees to provide the owners with all party member’s (who are over the age of 18) passport or ID information for the owner to copy and register all persons staying at the property in accordance to the tourism rental rules in Spain.

The renter agrees to treat the facilities and accommodation with due care so that other guests may continue to enjoy them. In the event of the renter noticing any damage, they must inform the owner immediately so that the appropriate action may be taken. The owners are aware that accidents can happen but request that the renter informs them of any breakages at the earliest convenience. If the owner deems any damage not to be as a result of an accident, the renter will be given the opportunity to replace the item or pay for the item. By not declaring any damage to the facilities or property prior to a final inspection by the owners will be deemed as an acceptance of liability for that damage by the renter.

All inventory and equipment must remain in the property/room/area that it was found in on arrival and not be taken away from the property.

The renter agrees to abide by the swimming pool rules which are, but without limitation: ensuring those who use the pool are able to swim or, if otherwise are supervised at all times, ensure that no one uses the pool whilst under the influence of alcohol or drugs, not to misuse or move any of the pool furniture, only use appropriate crockery by the pool as provided by the owners and ensure those under 18 are supervised at all times. The renter is aware that the owners will carry out pool maintenance during the duration of the booking.

The renter agrees to ensure that the property is secure at all times and lock all doors, close windows and gates are closed when the property is unoccupied.

The number of persons using the property at any time must not exceed 6 persons and only those people listed on the booking form can occupy the property. The owners reserve the right to terminate the booking without notice and without refund in case of a breach of this condition.

The renter may in no circumstance re-let or sublet the property, even free of charge.

Children under 18 must be supervised by their parents / guardian at all times.

Bookings cannot be accepted from persons under eighteen years of age.

The owners reserve the right to refuse a booking without giving any reason.

The owners or the owner’s representatives, hereinafter referred to as ‘Representatives’, reserve the right to enter the property, pool area and gardens at any time to undertake essential maintenance or for inspection purposes.

Tenancies normally commence at 16:00 unless otherwise agreed and all guests are required to vacate the property by 10:00 on the day of departure. This allows the property to be thoroughly cleaned and prepared for incoming guests. Departing guests are asked to leave the property as they found it as well as remove any rubbish. Whilst the owners will make every effort to ensure that no property is left behind by a renter, they do not accept any responsibility for lost property.

The renter agrees to adhere to the owner’s no-smoking and no pet policy. As such the renter will ensure that any smokers will only smoke outside the property or in a designated smoking area. Ignoring the no-smoking or no pets condition may result in loss of the renter’s security deposit and or incur additional expense for any extra cleaning required.

The internet connection is available at no extra cost subject to technical availability.

The owners shall not be liable for any temporary defect or malfunction of any equipment, machinery, appliance in the building, grounds or pool or, loss of mains electricity.

The owners reserve the right to terminate a holiday without compensation where the unreasonable behaviour of the renter, persons named on the booking (or their guests) may impair the enjoyment, comfort or health of others.

Any problem or complaint which the renter or the renter’s party have concerning their holiday, must be immediately reported directly to the owners/representatives who will endeavour to put the matters right. In accordance to Spanish law a complaints form is available on request. Any complaints reported to the owners/representatives after the renter has returned from holiday will not be considered by the owners.

The renter understands that at no time do the owners accept any responsibility for loss or damage of the renter’s and or guest’s property, persons or vehicles (including but without limitation to hire cars and bicycles) whilst staying at the property.

The owners reserve the right to make reasonable amendments or additions to these terms and conditions as necessary and without notice.

The property is privately owned and is the owner’s home. As such, the owners expect all guests to enjoy the facilities and treat the property with the same respect that they would with their own home.
